This Contract:
This contract sets out the complete Terms and Conditions (hereinafter called "These Terms and Conditions") which shall be applied to Zemen Gebeya e-commerce platform.
These terms and conditions, as well as any related amendments or changes, will become effective once the customer has read and accepted them (by clicking on the option to “agree”.

1. Definition
1.1. "Customer/buyer " means any person who purchases products and services through Ethio telecom Zemen Gebeya e-commerce platform
1.2. "Customer Account”: means telebirr account used by the customer and through which the customer makes payments to the merchant for purchased goods/services
1.3. "Customer Account Information" shall mean the information provided by the customer to use Zemen Gebeya e-commerce platform.
1.4. "Merchant" any person who has a business license and entered a contract with Ethio telecom for selling goods and/or services to customers via the Zemen Gebeya e-commerce platform.
1.5. "Merchant Account”: Means the telebirr account operated by the merchant and through which the merchant receives payments of products and services from the customers.
1.6. “Delivery location” means a location provided by the customer where the purchased good/service to be delivered.
1.7. “Pickup location” means the nearest location to the customer /buyer where the logistic service provider put the product for the purpose of delivery or the place where the logistic service provider put products when the customer fails to collect its service during delivery.
1.8. “Escrow account” is a telebirr account operated by Ethio telecom to hold customer payments temporarily until the customer confirms delivery of purchased goods/services. However, the payment will be released to the merchant account automatically upon delivery confirmation or after five (5) days starting from the purchase date.
1.9. “Standard delivery” means a delivery method where customers receive the product they purchased from one to five days.
1.10. “Express delivery method” refers to a delivery method in which customers receive the product they purchased within 6 hours.
1.11. “Product description” means the right information that displayed on the Zemen Gebeya e-commerce platform and tells customers including but not limited to price, quality, size, quantity, weight … the product /service available to be sold.
1.12. “Store” means Zemen Gebeya e-commerce platform marketplace where the merchant avails its product and service to be sold.
1.13. “telebirr” means trade name of Ethio telecom mobile money service used to access payment services.
1.14. “Zemen Gebeya" Means an e-commerce platform provided by Ethio telecom to perform an Online selling and buying of goods and services and receive payment.
1.15. "Terms" Means terms and conditions of this contractual agreement
1.16. “We” refers Ethio telecom.
1.17. “You” stands for the customer who uses the Zemen Gebeya e-commerce
1.18. ‘’Working days’’ means a day other than, Sunday and public holidays in Ethiopia.
2. Acceptance of Terms and conditions.
2.1. These terms and conditions, as well as any related amendments or changes, will become effective once the customer has read and accepted them (by clicking on the option to agree” and start accessing or using this platform and placing an order.
2.2. If you do not agree with these Terms and Conditions, please do not click the “agree” option and click "Quit" on the Menu.
2.3. These terms and conditions apply to all visitors, users, and others who access the platform.
2.4. Ethio telecom reserves the right to update or modify these Terms and Conditions at any time. Upon change, a change notification will be sent to you through appropriate communication channels.
3. Activation for Zemen Gebeya
3.1. To activate Zemen Gebeya e commerce service:
3.1.1 You should be able to read, understand and accept these terms and conditions.
3.1.2 You should be 18-year-old and above.
3.1.3 You should have an Ethio telecom active SIM card
3.1.4 You should have active telebirr account
3.2 You agreed to notify Ethio telecom immediately if you suspect unauthorized access to your account.
3.3 By creating a telebirr account, you agree to provide accurate and complete information. You are responsible for all activities that occur under your account.
4 Product availability
4.1 The Product description displayed on Zemen Gebeya e-commerce platform is accurate.
4.2 Merchants reserve the right to modify product price, image, store, specifications, descriptions, or shelf of the products, without your prior notice, at any time.
4.3 The product's packaging may vary from that is shown on the platform.
4.4 By placing an order, you are making an offer to purchase the products in your cart.
4.5 You will receive on Zemen Gebeya in app notification that confirms we have received your order.
4.6 An order is only considered accepted when you pay the product price via telebirr.
5 Payment
5.1 We only accept payments made via telebirr.
5.2 You should provide accurate and complete payment information.
5.3 By providing your payment information, you are authorized to pay the total amount of your order, including applicable taxes and delivery fees.
5.4 The payment will be held temporarily on the Escrow account to protect you until your delivery confirmation. However, the payment will be released to the merchant account automatically upon delivery confirmation or after five (5) days starting from the purchase date.
5.5 The payment will be immediately transfer to the merchant telebirr account upon your delivery confirmation.
5.6 If there is a sudden shortage of product/service or cancellation of your order or the existence of force majeure after the payment, the payment you made will be restored to your telebirr account.
6 Shipping and Delivery
6.1 We strive to process the orders within 1- 5 days based on the delivery type and location.
6.2 Orders placed on weekends or holidays may take longer delivery time.
6.3 The specific estimated delivery time will be displayed during your checkout.
6.4 The delivery time varies depending on the delivery option you choose.
6.5 Ethio telecom is not responsible for the incorrect delivery location information you provided.
6.6 You must avail yourself at the delivery location to receive the product you ordered.
6.7 If you are unable to collect the product at the delivery location, you should forward the SMS you received for delivery confirmation to the person you delegated to receive the product on your behalf.
6.8 Upon receiving the SMS, the delegated person should show the message you forwarded to the delivery person for confirmation purposes and collect the product.
6.9 If you are not available and collect the product delivered to you, we will place the product at the nearest pickup location, and you can collect by yourself.
6.10 Delivery Types:
6.10.1 Standard delivery:
• Addis Ababa /Regional towns: If you and the merchant reside in Addis Ababa/ in the same regional towns, the product you order will deliver within one day.
• Region to Region: If you and the merchant live in different regions, the product you order will deliver from three to five days.
• Addis Ababa to regions: If the merchant resides in Addis Ababa and your location is at any region, the product you order will deliver from three to five days.
• Region to Addis Ababa: If you reside in Addis Ababa and the merchant is at any region, the product you order will deliver from three to five days.
6.10.2 Express delivery: If you and the merchant reside in Addis Ababa and select the express delivery method, we will deliver the product you ordered in 6 hours.
6.10.2.1 If you and the merchant reside in the same regional cities, we will deliver the product you ordered in 6 hours.
6.10.2.2 If you order the product after 3:00 PM, your order will be delivered as per your order type counted beginning from the next day working hour.
6.11 When you receive the product, you shall confirm your acceptance via the Zemen Gebeya e-commerce platform.
6.12 If you receive the product and fail to confirm the delivery within 5 working days, the payment will be settled to the merchant account automatically.
6.13 If you fail to take your orders from our pickup centers within 5 working days, we will charge you 1% (maximum of ETB 500) of your product price every day till it becomes equivalent to the product price.
6.14 We will not be responsible for the damage that may result from extended storage.
6.15 If you still fail to collect the product, Ethio telecom will follow its disposal process.
7 Delivery
7.1 For home-to-home delivery, we will deliver the product to your delivery place if the product is handable, and your delivery place is accessible for transportation.
7.1.1 We will deliver the product to your home or a specific convenient place if the product is easy and handable.
7.1.2 You should collect your product at your gate. if the product weight needs unloading, you are expected to do it by yourself.
7.1.3 If you are not willing to unload the ordered products by yourself, Ethio telecom will be obliged to take back the order to its Pick-up service center, and you shall come in person and take your order at our pick-up service centers. If not, the same rule of warehouse cost and disposal process will be applied as mentioned in Articles from 6.12- 6.14 above.
7.2 Delivery address
7.2.1 You should provide a complete and accurate delivery address as per the request of the Zemen Gebeya e-commerce system.
7.2.2 If you update your address, ensure your delivery address is up to date before placing an order to prevent delivery issues.
7.3 Home-to-home delivery
7.3.1. When you receive the product, you shall confirm your acceptance via the Zemen Gebeya e-commerce platform.
7.3.2. If you fail to collect your product within 5 working days from our self-pickup centers, we will charge you for warehouse and other costs. If you still do not collect the product, Ethio telecom will follow its disposal process.
7.4. Product Purchasing Date and Time
You can purchase products at any time, but the delivery will be on working days.
7.5. Delivery cost
• The delivery cost will be shown on the checkout and payment summary.
7.6. Order tracking
• You can track your order status via the Zemen Gebeya e-commerce mini app.
8. Returns and Refunds
8.1. Return Eligibility
8.1.1. With the exception off perishable items described in Article 7.2.3. of these terms of use You can request a product return within 2 calendar days of receiving your order.
8.1.2. Failure to inspect and raise any concern relating to the accuracy of the product description, its conformity and functionality will be considered as waiver of any right.
8.1.3. A product return claim will be indicted only if the item received is damaged or defective or it is entirely different from what you have ordered.
8.1.4. The product must be unused, in its original condition, and in the original packaging.
8.2. Return Process:
• You must send your return request directly to the merchant via Zemen Gebeya e-commerce platform. If your request is not handled within 48 working hours, you can escalate the issues to Ethio telecom.
8.3. Non-returnable Items
• Perishable goods, such as food, flowers, newspapers or magazines, health and hygiene products, intimate apparel and lingerie, cosmetic items that have been opened or have the seal broken, hazardous materials, flammable liquids or gases, gift cards, etc., are not eligible for a return. Please check detailed product descriptions before placing the order.
8.4. Return Shipping Costs
• Unless the product is damaged or defective or it is entirely different from what you have ordered or there is an error in your order from the merchant/logistics side, you are responsible for return shipping costs.

8.5. Change /Replacement
• If the product is found defective, damaged, or not what you have ordered, by discussing with the merchant, you can request a change or replacement of the product. The merchant shall remedy the defective good or provide new product which is same with the ones ordered within a maximum of 7 days. Should the merchant fail to maintain or replace the defective goods with in the above prescribed time, the customer is entitled to cancel the order and get refund for the paid amount.
• The merchant will facilitate the exchange request by itself.
9. Privacy and Data Protection
9.2. We respect customers' data protection right and their privacy. However, we shall use customers' data to provide and improve the e-commerce services we provide.
9.3. You are solely responsible for maintaining the security of any activities, passwords, and other accounts.
9.4. You are responsible for maintaining the confidentiality of your telebirr account information, including your password.
9.5. You agreed to notify Ethio telecom immediately if you suspect unauthorized access to your account.
9.6. You agree to receive notifications from the platform including promotional content.
9.7. By using the platform, we can access your personal information to provide the Services. You also authorize us to provide such information to third-party providers and suppliers. The Customer consented to Ethio telecom for use of the data for offering personalized telecom or digital financial services
10. User Conduct
• By using this application, you agree not to engage in the following:
o Illegal Activities: Do not use the application for any unlawful purpose.
o Harmful Actions: Do not attempt to interfere with or disrupt the functionality of the application.
o Infringement: Do not violate the intellectual property rights of Ethio telecom or others.
o We may suspend or terminate your account if you engage in any of these prohibited activities and may result in criminal responsibility.
11. Intellectual Property
All content on this Site, including text, graphics, images, logos, and software, is the intellectual property of Ethio telecom or its licensors. You may not use any content from this application without prior written consent.
12. Limitation of Liability
12.2. To the fullest extent permitted by law, Ethio telecom shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, resulting from the use or inability to use our products or services, even if we have been advised of the possibility of such damage.
12.3. All information, content, materials, products, and other services included on or otherwise made available to you through the e-commerce platform provided on an "as is" and "as available" basis unless otherwise specified in writing within the platform.
12.4. Ethio telecom makes no representations or warranties of any kind, express or implied, as to the operation of the -e-commerce platform, or the information, content, materials, products, or other services included on or otherwise made available to you through the e-commerce platform, unless otherwise specified in writing.
12.5. You expressly agree that your use of the platform is at your sole risk.
12.6. Ethio telecom and its affiliates will not be liable under any circumstances (including contract, warranty, tort, product liability, or any other theory), regardless of the terms and conditions apply to any other person or entity any indirect, incidental, special, punitive, or substantial loss.
12.7. Minors (those under the age of 18) are not targeted to this platform and if a minor has provided us with personal data without parental or guardian consent, the parent or guardian should contact us to remove the information.
13. Governing Law and Dispute Resolution
• Governing Law: These Terms are governed by the laws of Ethiopia without regard to its conflict of law principles.
• Dispute Resolution: Any dispute arising from these Terms and conditions will be resolved amicably through negotiation.
• If parties fail to reach in an agreement, both parties agreed to submit their case before the competent court
14. Force Majeure
• The presence and absence of Force majeure shall be determined by the relevant laws of Ethiopia.
22.1. Ethio telecom will not be held liable where non-performance is due to force majeure.
15. Modification of Terms
• We may update or modify these Terms and Conditions at any time, and any changes will be communicated by the appropriate channel
• Changes to these Terms and Conditions will be effective as of the date they are posted.

Please log in to your telebirr SuperApp and click Zemen Gebeya mini app, then agree to the terms and conditions.

You can see the terms and conditions details under “My” in the platform.

Use the search bar at the top of Zemen Gebeya miniapp, enter keywords related to the product you're looking for, and use filters to narrow down the search results by category, price, brand, etc.

Once you log in to telebirr, you will get Zemen Gebeya mini app, and in there you can order your preferred items by browsing the preferred items and “add to cart”. Review your order details and Click ‘Check-out’. Fill out your shipping information and click on “Confirm Order,” and proceed to payment.

You can place your order at any time, but the delivery dates will depend on the business hours.

As per Zemen Gebeya’s policies, you can change or cancel an order within a short time frame after placing it, i.e., before the merchant confirms the order. After that, it is not possible to change or cancel the order. Also, contact customer support or the seller directly to request changes or cancellations.

Our current mode of payment is telebirr. If the available balance is limited, you can transfer from any banks, Agent, or Ethio telecom service center as per telebirr procedures.

Get into Zemen Gebeya mini app, go to "My" find the relevant order, and click on "View all" to see the latest shipping status and tracking information.

All the products that are displayed on Zemen Gebeya are available. We put in our best effort to ensure the availability. The system will notify you as soon as it happens.

Your items will be delivered between 1-5 days based on delivery types after payment confirmation of your order. For orders issued after 3 PM, Sunday and public holidays, delivery will be considered starting from the next working day.

You or the assigned person shall present valid and original national or Kebele ID, Driving License or Passport.

Yes, the items can be collected by anyone, but you shall write the correct delivery/collector information on the shipping/collector information. You and the assigned person also need to confirm the integrity of the delivery and confirm whether the order is correct and with the stated requirements.

Except the perishable items, you can request a product return within 2 days of receiving your ordered product. Check our terms and conditions or the product page for specific return policies.
